Terms & Conditions

1. Our Services

XMT provides AI-assisted call handling and business automation services.

Depending on the selected plan, services may include:

  • Missed-call handling and recovery

  • Collection of caller and job information

  • SMS confirmations and follow-ups

  • Business notifications

  • Lead-management dashboards

  • Callback requests

  • Appointment requests and bookings

  • Calendar connections and reminders

  • Setup, testing and reasonable technical support

The exact services, inclusions and prices are those displayed on our website, checkout page, invoice, proposal or order confirmation.

Additional work outside the selected plan may require a separate fee, which will be agreed to before the work begins.

2. Setup, Compatibility and Client Responsibilities

XMT relies on call forwarding and other third-party systems. We may complete a free compatibility check before paid setup begins.

A successful compatibility check does not guarantee that the service will remain permanently compatible. Telephone carriers, forwarding settings, internet services and connected platforms may change or experience interruptions.

The client must provide accurate and current information, including business details, opening hours, services, call-handling preferences, calendar availability and notification contacts.

The client is responsible for:

  • Maintaining their telephone and internet services

  • Keeping account details and passwords secure

  • Reviewing scripts, messages and workflows

  • Checking important caller and appointment information

  • Informing XMT of changes to their carrier, number, calendar or business

  • Responding appropriately to customer enquiries

  • Using customer information lawfully

Setup timeframes begin once the required information, access and payment have been received.

3. AI and Third-Party Limitations

XMT uses artificial intelligence and automated systems. These systems may misunderstand speech, names, addresses, dates, times, job details or caller intentions.

Background noise, unclear speech, accents, poor connections and third-party outages may affect performance.

Clients must verify important information before acting on it. XMT does not guarantee:

  • That every call will be successfully completed

  • That all information collected will be accurate

  • That every SMS or notification will be delivered

  • That every caller will provide the requested details

  • Any specific number of leads, bookings, customers or sales

The service must not be relied upon for emergencies, urgent health or safety situations, or medical, legal or financial advice.

XMT also relies on third-party providers, including telephone carriers, SMS services, email providers, CRM platforms, AI providers, calendars, payment processors and cloud services. We cannot guarantee the uninterrupted operation of systems outside our control.

4. Fees, Trial and Automatic Billing

All prices are stated in Australian dollars unless otherwise shown.

The client agrees to pay:

  • The setup fee shown before purchase

  • The recurring subscription fee

  • Disclosed telephone, SMS and other usage charges

  • Any separately approved additional work

Where a 14-day trial is offered, the trial begins when the service is activated and made available for use or testing.

Unless otherwise stated:

  • The trial applies to the recurring subscription fee

  • The setup fee remains payable

  • Telephone and SMS usage charges remain payable

  • The client may cancel before the trial ends to prevent the first subscription payment

  • The subscription automatically continues after the trial unless cancelled

Monthly subscriptions automatically renew until cancelled. By purchasing a subscription, the client authorises XMT and its payment provider to charge the nominated payment method for recurring fees and disclosed usage charges.

If payment fails, XMT may retry the payment and contact the client. The service may be suspended after reasonable notice if payment remains overdue.

XMT will provide reasonable notice before materially increasing a recurring subscription price.

5. Cancellation and Refunds

Clients may cancel their subscription at any time by emailing:

A cancellation request received before the next billing date will prevent the next monthly subscription charge.

Unless otherwise agreed, the service will remain available until the end of the current paid billing period. Outstanding telephone, SMS or other usage charges remain payable.

Setup fee refunds

A full refund of the setup fee may be provided where:

  • The client cancels before setup work begins

  • XMT determines that the service cannot reasonably be made compatible

  • XMT cannot provide the purchased setup service

If the client cancels after setup work has started, XMT may deduct a reasonable amount for work already completed and non-refundable costs already incurred.

The setup fee is not normally refundable for a change of mind after setup has been completed and the service has been activated.

Subscription refunds

XMT does not normally provide refunds for:

  • A change of mind

  • Failure to use the service

  • An unused portion of a monthly billing period

  • Cancellation after a new billing period has started

  • Problems caused by the client’s carrier, equipment, internet connection or unauthorised changes

Incorrect or duplicated charges will be corrected or refunded after verification.

Where the service has not been provided as agreed, XMT may correct the problem, repeat affected work, provide an account credit, cancel the service or issue an appropriate refund.

Nothing in these Terms limits rights that cannot legally be excluded under the Australian Consumer Law.

6. Privacy, Customer Information and Call Recording

XMT handles personal information in accordance with its Privacy Policy.

The client retains ownership of their business and customer information. The client gives XMT permission to access, process, store and transmit that information where reasonably necessary to provide and support the service.

Where call recording or transcription is enabled, the client is responsible for ensuring that its use complies with applicable laws and any notice or consent requirements.

XMT may assist with configuring a message informing callers that they are speaking with an AI assistant and that their call may be recorded or transcribed. This assistance does not constitute legal advice.

The client should not use the service to collect unnecessary sensitive information.

7. Intellectual Property

The client retains ownership of their existing:

  • Business name and branding

  • Customer information

  • Business content

  • Documents and materials supplied to XMT

XMT retains ownership of its existing and reusable:

  • Workflows

  • Templates

  • Automation structures

  • Configuration methods

  • Documentation

  • Designs

  • Training materials

  • Website content and branding

Payment for setup does not transfer ownership of XMT’s reusable systems, templates or methods.

The client may use their configured XMT service for ordinary business operations while their subscription remains active.

8. Availability, Suspension and Termination

XMT aims to provide a reliable service but does not guarantee that it will always be uninterrupted or error-free.

Maintenance, carrier faults, internet outages, provider changes, cybersecurity incidents and events outside XMT’s reasonable control may affect the service.

XMT may suspend or terminate a service where the client:

  • Fails to pay an overdue amount after reasonable notice

  • Uses the service unlawfully or deceptively

  • Attempts to compromise XMT or third-party systems

  • Provides materially false information

  • Seriously or repeatedly breaches these Terms

Where reasonably possible, XMT will provide notice and an opportunity to correct the issue.

Immediate suspension may occur where necessary to protect people, information, systems or third-party services.

9. Liability, Disputes and Contact

Clients are responsible for checking AI-generated and caller-provided information before relying on it.

To the maximum extent permitted by law, XMT is not responsible for indirect or consequential loss caused by:

  • Unverified or inaccurate caller information

  • Client decisions or failure to follow up an enquiry

  • Telephone-carrier or internet failures

  • Third-party platform interruptions

  • Changes made without XMT’s approval

  • Events outside XMT’s reasonable control

Nothing in these Terms excludes or limits a consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

If a dispute occurs, both parties agree to first attempt to resolve it promptly and in good faith.

These Terms are governed by the laws of Western Australia. If part of these Terms is found to be invalid or unenforceable, the remaining sections will continue to apply.

XMT may update these Terms by providing reasonable notice. If a change materially disadvantages an existing client, the client may cancel before the change takes effect.
